The Trimble Banner publishes all misdemeanors, felonies and small-claims judgments recorded in district court, as well as all civil suits recorded in circuit court. Juvenile court cases are not published.

Crime reports are provided by local law enforcement agencies. Charges or citations reported to The Trimble Banner do not imply guilt.

The following cases were heard the week of April 8, 2014.

FELONIES

Kirk Savage – arraignment – theft by unlawful taking $500 or more but under $10,000. Not guilty plea, continued to 4-15-14.
Michael A. Edens - preliminary hearing – 1st degree possession of a controlled substance (methamphetamine) 1st offense, 2nd degree possession of a controlled substance 1st offense, possession of drug paraphernalia – guilty plea, $250 fine suspended for 2 years, 15 days conditionally discharged 2 years; possession of marijuana – guilty plea, $250 fine; failure of owner to maintain required insurance, speeding 8 mph over the limit, rear license not illuminated, dismissed. $153 court costs and completion of substance abuse classes due 10-7-14.
Mary Lou McKinney McFarland - preliminary hearing – 1st degree possession of a controlled substance (methamphetamine) 1st offense. Dismissed without prejudice.
Gary Redfern - preliminary hearing – 1st degree possession of a controlled substance (methamphetamine) 1st offense, possession of a controlled substance 2nd or more offense, 2nd degree possession of a controlled substance 1st offense, possession of drug paraphernalia. Defendant stipulates violation of pretrial release, placed back on original bond conditions with requirement to set substance abuse assessment within 30 days, any other violations, bond will be revoked pending trial.
Jack M. Hicks - preliminary hearing – manufacturing methamphetamine 1st offense, unlawful distribution of a meth precursor 1st offense, possession of drug paraphernalia, unlawful possession of a meth precursor 1st offense, endangering the welfare of a minor. Not guilty plea, probable cause found. Refer to Trimble County Grand Jury.
James Andres Huff, II - pretrial conference – 2nd degree fleeing or evading police in a vehicle, failure of owner to maintain required insurance, 1st degree fleeing or evading police on foot, 2nd degree fleeing or evading police on foot, operating on suspended/revoked license. Remand – Jury trial 5-22-14. Suppression hearing 5-1-14.
Tonya R. Brashears – diversion completion – dismissed.
Haley S. Asher - preliminary hearing – unlawful distribution of a meth precursor 1st offense. Guilty plea, amend to attempted unlawful distributing of meth precursor. $153 court costs, 365 days jail conditionally discharged for 2 years, continued to 5-20-14.

MISDEMEANORS

Diane E. Fisher - show cause hearing – if not paid then bench warrant (restitution) $379.35. If paid, recall.
John C. Harris – arraignment – speeding 12 mph over the limit – guilty plea, state traffic school $153 court costs; failure to produce insurance card amend to failure of owner to maintain required insurance 1st offense. Guilty plea, $500 fine $400 suspended; possession of marijuana – guilty plea, $250 fine, 15 days conditionally discharged 2 years; possession of drug paraphernalia – dismissed. Proof of substance abuse assessment 10-7-14.
Jessica Moore - pretrial conference – (2) 3rd degree unlawful transaction with a minor, continued to 4-22-14.
Erin Thompson – arraignment -4th degree assault with minor injury. Continued to 5-6-14.
Amber L. Wyatt - pretrial conference –possession of marijuana, possession of drug paraphernalia. Guilty plea, 15 days conditionally discharged 2 years, $500 fine, $153 court costs due 12-16-14; proof of substance abuse class completion by 7-29-14.
Charles C. Aaron - pretrial conference – 4th degree assault domestic violence with minor injury, 3rd degree criminal mischief. 6 month deferral, review 10-7-14 for dismissal.
Kenneth N. Jackson – show cause hearing – failed to appear, bench warrant issued, DOT notified, $883 due.
Henry R. Whaley - pretrial conference – theft by unlawful taking/shoplifting under $500. Guilty plea, 30 days conditionally discharged 2 years, $153 court costs. Restitution hearing 4-22-14.
Harry Mercer – arraignment – theft by deception including cold checks under $500. Guilty plea, 30 days conditionally discharged 2 years. Restitution, fees and court costs - $714.67. Continued to 5-20-14.
Harry Mercer – arraignment – theft by deception including cold checks under $500. Guilty plea, 30 days conditionally discharged 2 years. Restitution, fees and court costs - $363.79. Continued to 5-20-14.
Lisa A. Ely – other hearing – remand 4-10-14 trial date; jury trial 6-12-14.
Melvin L. Ely - other hearing – remand 4-10-14 trial date; jury trial 6-12-14.

TRAFFIC

Joseph Hayden – arraignment – operating on suspended/revoked license. Not guilty plea, continued to 5-20-14.
Mikel L. Rippey - show cause hearing – proof shown.
John L. Gosman - pretrial conference – operating a vehicle under the influence of alcohol/drugs 1st offense. Continued to 4-22-14.
James D. Copple, Jr. - pretrial conference – speeding 14 mph over the limit, rear license not illuminated, license to be in possession, operating a vehicle under the influence of alcohol/drugs 1st offense. Continued to 4-22-14.
Richard Trent, Jr. - pretrial conference – operating a vehicle under the influence of alcohol/drugs aggravator, 2nd offense.  Not guilty plea, continued to 5-6-14 with $200 public defender fee due.
James D. Walker - pretrial conference – no/expired plates, failure of non-owner operator to maintain required insurance 1st offense. Failed to appear, DOT notified.
Kimberly Yarber - pretrial conference – failure of owner to maintain required insurance 1st offense – Not guilty plea, continued to 4-22-14; no operators license, dismissed.
Casey R. Streiner – arraignment – speeding 17 mph over the limit, possession of open alcohol container in a vehicle, dismissed; operating a vehicle under the influence of alcohol/drugs aggravator 1st offense.  Guilty plea to DUI aggravator 1st offense, $718 fine due 6-17-14; Alcohol and drug education class due 5-6-14; 30 days suspension, 4 days jail – credit 1 day.
Timothy Helm – arraignment – speeding 13 mph over the limit, guilty plea, paid; failure to notify DOT of address change, dismissed.
Brandy M. Jupin - show cause hearing – paid $350, continued to 5-6-14.
Charla R. Cook - show cause hearing – paid $100, continued to 4-22-14 for balance.

PROBATE

Estate of Riley Lee Williams – probate hearing – petitioner was advised by court that she needed an agent for service of process. She left and said that she would return. She did not return. Remand. Petitioner is out of state and was advised to consult with an attorney as probate may not be required.
