The Trimble Banner publishes all misdemeanors, felonies and small-claims judgments recorded in district court, as well as all civil suits recorded in circuit court. Juvenile court cases are not published.
Crime reports are provided by local law enforcement agencies. Charges or citations reported to The Trimble Banner do not imply guilt.
The following cases were heard the week of Dec. 27-31, 2010.

FELONIES

• Martin T. Bayne, show cause for $143. Failed to appear-issue warrant for $173 cash, no surety.
• David H. Bird, criminal possession of forged instrument-2nd degree-11 counts. Continue to Jan. 4.
• Kristin Middeler, show cause. Review April 19.

MISDEMEANORS

• Douglas Cheek, criminal trespassing, 2nd degree, terroristic threatening, 3rd degree, menacing. Diversion-pass for 6 months and if no problems will dismiss. No contact with James Wilkins or his roommate or not to go on property; remain law abiding. Bond is applied to $100 diversion fee and balance to defendant. Review June 28.
• Benjamin T. Tharp, review on 3 cases. Continue to Jan. 11.
• Benjamin T. Tharp, other hearing. Defendant found in COC, alcohol use-tested positive. 14 days jail to serve. Review Jan. 11.
• Daniel J. Weakley, assault 4th degree domestic violence no visible injury. Pass for 12 months and if no problems will dismiss. Remain law abiding; no unlawful contact with Ms. Weakly or children; attend and complete Anger management-review Jan. 25 for proof of enrollment; pay $100 diversion fee today; refund bond. Review Dec. 11.

TRAFFIC

• Jacob R. Alexander, show cause for proof of enrollment in ADE program. Continue to Jan. 11 for proof.
• James E. Jones, show cause for proof of license and insurance. Guilty plea to amended charge license not in possession and failure to maintain insurance, 1st offense. $243 fine and court cost due. Apply bond from 10-T-432 and refund balance to surety. Charges on 10-T-432 merged and dismissed.
• Tricia L. May, review. Dismissed, successful diversion.
• Jeremy D. Sullivan, failed to appear review. Failed to appear-issue warrant for $748 cash, no surety if no proof of hospital by end of day.
• Jeremy D. Sullivan, operating motor vehicle under the influence of alcohol or drugs, .08, 3rd offense. Continue to Jan. 11.

CIVIL

• Norton Healthcare, Inc. vs Linda J. Smith. Review. Defendant failed to appear. Default judgment for plaintiff.
• Advantage Assets II, Inc vs Bernie L. Wade. Review. Dismiss per plaintiff. Order signed.

PROBATE

Estate of Betty Jean Handlon. Probate hearing. Will probated by Stacy Bruner, order signed, executrix appointed, bond signed and oath administered.
