Items published in court news are public record. The Trimble Banner publishes all misdemeanors, felonies and small-claims judgments recorded in district court, as well as all civil suits recorded in circuit court. Juvenile court cases are not published.
Crime reports are provided by local law enforcement agencies. Charges or citations reported to The Trimble Banner do not imply guilt. The following cases were heard in court the week of March 7-March 11, 2011

FELONY

  • Kevin Buerke, review. Recall bench warrant.
  • Jeremy Allan Garcia, flagrant non-support. Preliminary hearing Mar. 15 for good cause shown.
  • Benjamin David Hancock, flagrant non-support. Continue to Mar. 22.
  • Kevin A. Herald, 1st degree possession of controlled substance/opiates, 2nd or more offense, possession of controlled substance-3rd degree, 1st offense, drug unspecified. Preliminary hearing held. Probable cause exists; refer to grand jury for potential indictment. Bond remains same.
  • Michael Linton, failed to appear review. Amend bond to $250 USB and continue to Mar. 22.
  • Angela Carol Winkle, drug paraphernalia, buy or possession, 1st degree possession of controlled substance/drug unspecified, 1st offense. Not guilty plea entered. Preliminary hearing Mar. 22.

MISDEMEANOR

  • James E. Floyd II, possession of controlled substance, 3rd degree, 1st offense, drug unspecified, use or possession of drug paraphernalia, 1st offense. Continue to Mar. 22.
  • Jeremy W. Gaddis, assault 4th degree minor injury. Not guilty plea entered. Defendant to represent self on April 5.
  • James Huff, revocation hearing. Defendant stipulates violation of court order. Continue to Mar. 22-2 cases.
  • Michael S. Lettman, corrected to Michael S. Lehman. Open or drinking alcohol on package license permit-1st offense amended to open container in motor vehicle. Guilty plea entered. Fine and court cost of $178 due June 28.
  • Mickle L. Logsdon, show cause for $443 due. Continue to Mar. 22.
  • Armando Perez, review. Recall warrant and dismiss all charges. Defendant released and ICE held.
  • Shelby Stephens, operating motor vehicle under the influence of alcohol or drugs with .08, aggravator, 1st offense, menacing, resisting arrest, failure to notify address change to DOT. Failed to appear, issue warrant $1,000 cash and bond forfeit notice and notify DOT.
  • Cassie Yeary, show cause for $395.05 due in full. Failed to appear, issue warrant for $430 cash, no surety.

TRAFFIC

  • Robert Cerasi, operating motor vehicle under the influence of alcohol or drugs, etc., .08, 1st offense. Guilty plea entered to DUI, 1st offense. $718 fine and court cost due today, 30 days loss of license, attend and complete ADE program with proof of enrollment and completion.
  • William D. Clark, show cause for proof of alcohol and drug education program. Failed to appear. Notify DOT, issue warrant for $250 cash and proof of ADE.
  • Victor A. Ellis Jr., failure to wear seat belts, operating on suspended or revoked license. Not guilty plea entered. Continue to May 3 and bring valid license.
  • Donald Ely, speeding 16 mph over limit amended to 10 over limit, possession of open alcohol beverage container in a motor vehicle. Guilty plea entered. Fine and court cost of $163 due May 3. Speeding 19 mph over limited access. Guilty plea entered. State traffic school and $143 court cost due July 12.
  • Taylor Fox, failed to appear review. Amend bond to $2500 USB and continue to Mar. 22.
  • Daniel D. Fuller, failure to wear seat belts, operating on suspended or revoked operators license. Not guilty plea entered. Continue to April 5.
  • Jaime A. Gomez, speeding 10 mph over limited access. Failed to appear. Notify DOT.
  • Melissa M. Helm, improper passing, failure of owner to maintain required insurance or security 1st offense. Not guilty plea entered. Continue to May 17 for proof of 6 months paid insurance.
  • Kevin A. Herald, failure to wear seat belts. Refer to grand jury with other case.
  • Tabitha R. McAllister, no or expired registration plates dismissed per proof. Failure of owner to maintain required insurance/security 1st offense. Guilty plea entered. $243 fine and court cost due June 28.
  • Michael J. Murphy, failure to wear seat belts, failure to use child restraint device in vehicle; operating on suspended or revoked operators license. Guilty plea entered to license not in possession. $218 fine and court cost due June 14. Failure to surrender revoked operators license dismissed.
  • Israel Richardson, failed to appear review. In lieu of fine and court cost, credit for time served and close out. (Case from 2008.)
  • Jeremiah S. Sharp, show cause for proof of ADE classes. Continue to Mar. 22.
  • Danny L. Thompson, failure to wear seat belts, operating on suspended or revoked operators, failure of owner to maintain required insurance or security, 1st offense. Continue to April 19.
  • Amy M. Tomas, speeding 17 mph over limit, failure to use child restraint device in vehicle. Guilty plea entered. $224 fine and court cost due June 28. Failure of owner to maintain required insurance or security, 1st offense, license to be in possession dismissed per proof.
  • Kimberly J. Waldridge, failed to appear review. Continue to March 22.

  • LVNV Funding LLC vs Lori A. Hodyshell. Review. Order signed for case to remain on active docket.
  • National Check Bureau, Inc. vs Stuart A. MacLeod. Review. Order of satisfaction signed.
  • Norton Healthcare, Inc. vs Dallas Milliner, ET AL. Review. Denied, order signed.
  • Midland Funding LLC vs Mark Perry. Review. Failed to appear. Order signed and dismissed for lack of prosecution.
  • Anesthesia Associates of Louis vs Kevin M. Sims. Review. Failed to appear. Order signed dismissing for lack of prosecution.
