The Trimble Banner publishes all misdemeanors, felonies and small-claims judgments recorded in district court, as well as all civil suits recorded in circuit court. Juvenile court cases are not published.
Crime reports are provided by local law enforcement agencies. Charges or citations reported to The Trimble Banner do not imply guilt. The following court cases were heard the week of Feb. 7-11, 2011.

FELONIES

  • Michael Linton, review for $228.75 due. Continue to Feb. 22 to pay in full or appear in court.
  • James South, theft by unlawful taking. Continue to Feb. 22 to show proof of drug treatment.
  • Angela Dawn Wade, burglary, 1st degree. Preliminary hearing held. Probable cause exists; refer to grand jury for potential indictment. Bond remains same.

MISDEMEANORS

  • Elizabeth Conway, review-4 cases. Order of expungement granted.
  • James E. Floyd II, possession of controlled substance, 3rd degree, 1st offense, drug unspecified, use or possession of drug paraphernalia, 1st offense. Continue to Feb. 22.
  • Christopher Fluhr, terroristic threatening, 3rd degree. Continue to Feb. 22.
  • James Huff, other hearing and show cause for $143 due. Amend bond to $5,000 unsecured bond. Revocation hearing Feb. 22.
  • Jean Ann Mertz, failed to appear review. Defendant found in contempt of court. 30 days jail to serve.
  • Stacy Perry, theft by deception, including cold checks under $500. Dismissed without prejudice.
  • Adam Sachleben, failed to appear review. Guilty plea entered. Make restitution, fees and court cost of $328. Apply bond and balance will be refunded.
  • Shelby Stephens, operating motor vehicle under the influence of alcohol and drugs with .08, aggravator, 1st offense. Not guilty plea entered. Pretrial conference Feb. 22.

TRAFFIC

  • Zach T. Barrett, failure to wear seat belts, operating on suspended or revoked operator’s license. Not guilty plea entered. Pretrial conference Mar. 22.
  • Michael W. Beatty, failure to produce insurance card, operating motor vehicle under the influence of alcohol or drugs, .08, aggravator, 2nd offense. Continue to Feb. 22.
  • Nicole Bethany Durham, leaving scene of accident or failure to render aid or assistance, failure of non-owner operator to maintain required insurance, 1st offense. Not guilty plea entered. Pretrial conference Feb. 22.
  • Taylor Fox, show cause for payment. Failed to appear, issue warrant for $2500 cash, no surety.
  • Benjamin David Garrett, failure to produce insurance card. Dismissed per proof.
  • Danton Ross Harper, no or expired registration plates. Dismissed per proof.
  • Sam T. Parker, no or expired registration plates. Dismissed per proof.
  • Sara J. Rexroat, show cause for $200 due. Continue through today; recall DOT.
  • Jeremiah S. Sharp, other hearing. Guilty plea entered to DUI, 1st offense. $718 fine; 30 day loss of license; attend and complete ADE program, enrollment due Feb. 22. Recall Bench warrant and notice to DOT. Charges 2,3,4,5,6 and 8 all merged and dismissed. Charge 7-failure to maintain required insurance, 1st offense. Guilty plea entered. $500 fine, $400 suspended; $100 fine due Aug. 23. Total of $818 fine and court cost due Aug. 23.

CIVIL

  • Winterwood, Inc. vs Christy White, ETAL. Other hearing. Dismissed, no one appeared.
  • Capital One Bank, USA vs Jonathan D. Alsup. Review. Defendant failed to appear. Default judgment for plaintiff.
  • Capital One Services, Inc. vs Lillian Barnes. Review. Order of satisfaction signed.
  • CCMH Corporation DBA vs Lydia M. Cowan. Review. Order of dismissal signed.
  • Midland Funding LLC vs Darlene White. Review. Defendant failed to appear. Default judgment for plaintiff signed.

PROBATE

  • Estate of Addyson Nicole Finkle. Probate hearing. Order signed appointing administrator. Bond signed; oath administered.
