The following cases were heard the week of Dec. 13 throught Dec. 17, 2010.

FELONIES

Martin Bayne, show cause for $143 due. Continue to Dec. 28 for payment.

Celson U. Flores, fleeing or evading police. Guilty plea entered to amended fleeing/evading, 2nd degree. 30 days jail-to serve-11 days credit; Criminal mishief-2nd degree. Guilty plea entered to amended Criminal mischief 3rd degree; Balance of 12 months conditionally discharged for 2 years. Reckless driving merged and dismissed. Operating motor vehicle under the influence of alcohol/drugs with .08, aggravator, 1st offense. Guilty plea entered to DUI, 1st offense. $718 fine due Dec. 18; 30 days to serve concurrent with charge 1, $200 restitution to KSP, $10 restitution fee. 30 days loss of privilege to drive; attend and complete ADE program. No operators/moped license; improper parking violations, failure to produce insurance card, no/expired Kentucky registration receipt, failure to or improper signal merged and dismissed.

Tonya Renae Hampton, wanton endangerment 1st degree amended to wanton endangerment, 2nd degree. Continue to Jan. 11. Operating motor vehicle under the influence of alcohol/drugs, 0.08, 2nd offense dismissed per county attorney.

Kristen Middeler, sentencing. Defendant to have drug evaluation by Dec. 28.

Ramiro Nava, flagrant nonsupport. Not guilty plea entered, need interpreter for Dec. 21. Bond remains same.

Bernard M. Obremski, burglary, 2nd degree. Defendant waives to grand jury; waiver signed in open court.

James South, show cause for proof of enrollment in treatment. Defendant enrolled in 3rd step program, continue to Feb. 8, refund bond to surety.

Dennis Carl Wright, review. Ok, proof shown.

MISDEMEANORS

Jacob R. Alexander, show cause for proof of substance abuse program. Ok-proof shown.

Douglas Cheek, criminal trespassing, 2nd degree, terroristic threatening, 3rd degree, menacing. Not guilty plea entered. Pretrial conference Dec. 28.

James Cunningham, review. Diversion-pass for 6 months and if no problems will dismiss; remain law abiding; not to possess or consume any illegal drugs; court waives diversion fee; review June 14.

Randy Howard Sr., review. Ok, proof show; defendant allowed to plea guilty and case dismissed per successful diversion.

Brandy Jupin, review. Dismissed per successful diversion.

Dennis LaMothe, review. Open guilty plea as of Sept. 8, 2009; continue to June 14 for proof of compliance.

Brian Lewis, criminal trespassing-3rd degree. Dismissed without prejudice.

Stanley Long Jr., possession of marijuana, buying or possessing drug paraphernalia. Continue to Jan. 11.

Metina Yvonne Lynch Sanchez, criminal trespassing-3rd degree. Guilty plea entered. $193 fine and court cost due June 14.

Randy Mahoney, terroristic threatening, 3rd degree. Guilty plea entered. 30 days conditionally discharged for 2 years; no new offenses; $143 court cost due today; release bond to surety. Alcohol intoxication in a public place, 1st & 2nd offense merged and dismissed.

Jean Ann Mertz, show cause for $143. Failed to appear; issue warrant for $173 cash, no surety.

Daniel Shirk, review. Dismissed per successful diversion.

Heather Stoehr, criminal mischief, 3rd degree, theft by unlawful taking, terroristic threatening, 3rd degree. Continue to Jan. 11.

Benjamin T. Tharp, violation of EPO/DVO, alcohol intoxication in a public place, 1st & 2nd offenses-3 counts, assault 4th degree domestic violence minor injury-2 counts. Guilty plea entered. Continue for sentencing on Jan. 11. Contempt of court merged and dismissed.

William Wolf, possession of marijuana. Guilty plea entered. 45 days conditionally discharged for 2 years, attend and complete substance abuse program-June 14, no new offenses, $143 court cost due June 14. Use/possession of drug paraphernalia, 1st offense merged and dismissed.

Matthew A. Young, assault 4th degree domestic violence minor injury. Open guilty plea entered. Diversion for 12 months and if no problems will withdraw guilty plea and dismiss, no new offenses, no unlawful contact with Janice ward and Ashley Bradley, attend and complete anger management and alcohol counseling, proof of enrollment due Jan. 11. Apply $100 to diversion fee and balance of bond to defendant. Alcohol intoxication in a public place, 1st and 2nd offense merged and dismissed.

TRAFFIC

Jacob R. Alexander, reckless driving merged and dismissed. Operating motor vehicle under the influence of alcohol 0.02/drugs, etc. under 21 years of age. Guilty plea entered to Under 21 DUI. 30 days loss of license; attend zero tolerance under 21 program; proof of enrollment in ADE due Dec. 28; $343 fine and court cost due June 14.

Ricky A. Carter, failure to wear seat belts, failure to produce insurance card, no operators/moped license. Continue to Jan. 11 for proof.

William D. Clark, disregarding stop sign; operating motor vehicle under the influence of alcohol/drugs, 0.08-2nd offense. Not guilty plea entered. Pretrial conference Jan. 11.

Robert L. Conner, no/expired registration plates; failure of owner to maintain required insurance/security, 1st offense dismissed per proof.

Taylor Fox, failed to appear review. Apply bond to money due; continue to Feb. 1 to review for payment.

Tania M. Gould, failed to appear review. Continue to Jan. 11 with proof of insurance.

Christopher Heaton, speeding 15mph over limit; failure to wear seat belts. Diversion-pass for 6 months and if no problems will dismiss. $100 diversion fee paid today.

Jack M. Hicks, operating motor vehicle under the influence of alcohol/drugs, etc., 0.08, 1st offense; no insurance, 1st offense. Dismiss proof insurance shown. Leaving scene of accident. Guilty plea entered. $500 fine; $143 court cost; 270 days conditionally discharged for 2 years. License to be in possession. Guilty plea entered. $20 fine.

James E. Jones, show cause for license. Continue to Dec. 28.

Adam Q. Pollard, speeding 15 mph over limit, no/expired Kentucky registration receipt. Guilty plea entered. State traffic school; $243 fine and court cost due June 14. No/expired Registration plates, failure to register transfer of motor vehicle merged and dismissed. Continue to Jan. 11.

Sarah J. Rexroat, review. Failed to appear. Issue bench warrant for $230 cash, no surety.

Richard Thomas Robbins, show cause for $93 due. Paid $20 today; continue to March 22.

Jeremiah S. Sharp, operating motor vehicle under the influence of alcohol/drugs, etc., .08, 1st offense, no operators/moped license, no/expired registration plates, no/expired Kentucky registration receipt, improper display of registration plates, possession of open alcohol beverage container in a motor vehicle, failure to produce insurance card, improper equipment.

William J. Short, failure of non-owner operator to maintain required insurance, 1st offense. Dismissed per proof.

Douglas T. Silva, show cause for $663 due. Failed to appear, notify DOT; issue warrant $693 cash, no surety.

David M. Singer, failure to wear seat belts. Failed to appear, notify DOT.
