A shooting in Henry County last weekend left a former Trimble County resident dead.

Joseph D. Burch, 31, of New Castle, was pronounced dead Sunday, July 6 following a shooting that took place at Osage Court apartment complex in New Castle.

Robert Steven Elston, 54, a resident at the complex, has been charged with murder and was arraigned Monday in Henry County District Court. He pled not guilty to the charge and Judge Jerry Cosby set bail at $1 million.

According to a press release from the Kentucky State Police, Elston and Burch were involved in a verbal altercation at the complex prior to the shooting, which happened shortly before 3:30 p.m. The reason for the argument remains unclear, however KSP Public Affairs Officer Seth Willis said though the two men were acquaintances, they were not friends.

At the time of his death, Burch had pending criminal charges in Trimble County for animal cruelty. An employee at the Oldham County Court Clerk’s office confirmed he was charged in 2002 in Oldham County with assault, resisiting arrest and terroristic threatening.

It is unclear whether Elston has a prior criminal record. He is currently being held in the Carroll County Regional Detention Center and is scheduled to return to court July 14 for a preliminary hearing, where he is expected to be represented by an attorney from the public defenders office.

Burch was pronounced dead at the scene by Henry County Coroner Jimmy Pollard.

The case remains under investigation by KSP detective Kevin Johnson.
